This document outlines the terms and conditions that govern the use of the Pasabay carpooling app ("Service" or "App"). By accessing or using the App, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, you are not authorized to use the App.
To use the App, you must be at least 18 years old and have the capacity to enter into a legally binding contract. You must create an account with the App to use certain features, such as posting or booking trips. You are responsible for maintaining the confidentiality of your account login information and for any activity that occurs under your account.
The App may collect certain personal information from you, such as your name, email address, phone number, and location data. We may use this information to provide and improve the Service, to contact you about your use of the Service, and for other purposes described in our privacy policy. By using the App, you agree to the collection and use of your personal data as described in our privacy policy.
To book a trip on the App, you must first select a trip that is available in the Terminal and then confirm your booking by making payment through the App. The fee for each trip is determined by the driver, and you will be required to pay this fee through the App at the time of booking. If you cancel a trip booking, our cancellation and refund policy (described below) will apply.
You or the driver may cancel a trip booking at any time. However, if you cancel a trip booking at the last minute or without a valid reason, you may receive a bad review or be banned from using the Service. If a driver cancels a trip, you will be entitled to a full refund of the trip fee. If you cancel a trip booking, the amount of your refund will depend on the timing of the cancellation and the terms agreed upon by you and the driver.
The driver is responsible for ensuring that their vehicle is in good working condition and meets all local safety and licensing requirements. Passengers are responsible for their own safety while in the vehicle and are encouraged to wear seat belts at all times. The driver and passengers should also follow all local traffic laws and regulations while using the Service.
If a dispute arises between you and another user or the Service, we encourage you to try to resolve the dispute informally. If you are unable to resolve the dispute informally, you may file a formal dispute with us. We will review the dispute and determine an appropriate resolution, which may include mediation, arbitration, or other forms of dispute resolution.
After a trip, you and the driver will have the opportunity to rate and review each other. These ratings and reviews will be visible to other users of the Service and may impact the driver's ability to use the Service. You agree to provide fair and accurate ratings and reviews and not to abuse the rating and review system.
If you experience or witness inappropriate or unsafe behavior while using the Service, you should report it to us immediately. We will review any reports of inappropriate or unsafe behavior and take appropriate action, which may include banning a user from the Service.
We are not liable for any damages or injuries that may occur while using the Service, including damages or injuries caused by the driver or other passengers. You agree to release us from any claims or liability arising from your use of the Service.
We may use your personal data and other information collected through the Service to send you marketing and advertising materials. You may opt out of receiving these materials at any time by following the opt-out instructions in the communications or by contacting us.
You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Service by, any other person. You may not use the Service to engage in any conduct that is unlawful, fraudulent, or that could damage or impair the Service or the reputation of the Service.
We welcome your feedback and complaints about the Service. You can submit your feedback or complaints to us through the App or by contacting us through the contact information provided on the App. We will review and address all feedback and complaints in a timely manner.
If you allow a guest or child to use the Service under your account, you are responsible for their actions and for ensuring that they comply with these terms and conditions.
Any disputes that arise between users or between users and drivers or the Service shall be resolved through informal negotiation or formal dispute resolution processes as described above.
The Service is intended for use in the Philippines. If you access the Service from outside the Philippines, you do so at your own risk and are responsible for complying with the laws and regulations of your jurisdiction.
We reserve the right to change these terms and conditions at any time. If we make material changes to these terms and conditions, we will notify you through the App or by other means. By continuing to use the Service after such changes, you agree to be bound by the revised terms and conditions.
The Service is not intended for use by minors under the age of 18. If you are under the age of 18, you are not authorized to use the Service.
We may be required to disclose your personal data or other information to government agencies in response to lawful requests. We will disclose such information in accordance with applicable laws and regulations.
You agree to comply with all local laws and regulations that apply to your use of the Service.
Any disputes that are not resolved through the informal or formal dispute resolution processes described above shall be resolved through binding arbitration or in a court of competent jurisdiction.
We will make reasonable accommodations for users with disabilities, in accordance with applicable laws and regulations.
We may receive requests for user data from third parties, such as credit agencies or law enforcement agencies. We will only disclose user data in response to these requests if we are required to do so by law or if we believe that such disclosure is necessary to protect the safety or rights of the Service or its users.
The Service is intended for personal use only and may not be used by professional drivers or for commercial purposes.
We reserve the right to delete or deactivate user accounts that have been inactive for an extended period of time or that violate these terms and conditions.
If you believe that your intellectual property rights have been infringed upon through the use of the Service, you may file a complaint with us. We will review and address all intellectual property complaints in a timely manner.
Any disputes related to the collection, use, or disclosure of personal data through the Service shall be resolved in accordance with our privacy policy and applicable laws and regulations.
Any disputes related to advertising or marketing practices on the Service shall be resolved through the complaint and feedback process described above.
You may bring pets or other animals with you on trips booked through the Service, but you are responsible for ensuring that they do not cause a disturbance or pose a safety risk to other users. Furthermore, the driver has the right to refuse service for any reason. Make sure you provide them with sufficient information about what you bring with you on the trip.
If you have concerns about the security or safety of the Service, you should report them to us immediately. We will review and address all security and safety concerns in a timely manner.
The driver reserves the right to refuse service to any passenger for any reason, including but not limited to disruptive or dangerous behavior, requests for service outside of the driver's specified route, or requests for service that would require the driver to break local laws or regulations. If a driver refuses service to a passenger before the trip has started, the passenger will be entitled to a full refund of the trip fee. The driver's decision to refuse service will be final and will not be subject to dispute or appeal. If a driver refuses service to a passenger after the trip has started, the passenger will not be entitled to a refund or any other compensation.
We may share user data with our affiliated or partner companies for purposes such as marketing and advertising, but we will only do so in accordance with our privacy policy and applicable laws and regulations.
You may not use the Service to transport hazardous materials or illegal items. If you violate this provision, you may be banned from using the Service and may be subject to legal action.
If you suspect that someone is using the Service to commit fraud or a financial crime, you should report it to us immediately. We will review and address all reports of fraud or financial crime in a timely manner.
We may disclose user data to credit agencies or financial institutions in connection with credit decisions or financial transactions. We will only disclose such data in accordance with applicable laws and regulations.
The Service is intended for personal use only and may not be used with commercial vehicles or for commercial purposes.
Any disputes related to regulatory compliance or violations of laws or regulations shall be resolved in accordance with applicable laws and regulations.
We may disclose user data to external auditors or regulatory bodies in order to comply with laws and regulations or as part of an audit or investigation. We will only disclose such data in accordance with applicable laws and regulations.
Drivers are required to ensure that their vehicles are properly insured and compliant with all local laws and regulations. If you have concerns about the insurance or compliance of a driver's vehicle, you should report it to us immediately.
